Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of porshn.com and the Porshn waitlist (the "Site"). The Site is operated by Patryk Domałeczny, a natural person residing in Poland ("Porshn", "we"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to use the Site or submit your email to the waitlist. By using the Site you represent that you are 18 or older.

3. The waitlist

The waitlist is a non-binding signup to be notified when Porshn (the product) becomes available. We do not guarantee a launch date, continued availability, or that you will receive an invitation. Submitting your email does not create a contract to provide the Porshn product.

4. Acceptable use

You agree not to:

• use automated means (scripts, bots) to submit the waitlist form or otherwise abuse the Site;
• attempt to probe, scan, or test the vulnerability of the Site or breach security or authentication measures;
• use the Site to transmit any unlawful, harassing, defamatory, or infringing content;
• reproduce, duplicate, copy, sell, or exploit any portion of the Site without our written permission, except as permitted by applicable law.

5. Intellectual property

All content on the Site (text, graphics, logos, design) is owned by Porshn or its licensors and is protected by Polish and international copyright laws. The name "Porshn" and its logo are trademarks (claimed) of Patryk Domałeczny. You are granted a limited, non-exclusive, non-transferable license to view the Site for personal, non-commercial purposes.

6. Third-party links

The Site may contain links to third-party websites. We are not responsible for their content or practices. Access them at your own risk.

7. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits or excludes liability for death, personal injury, fraud, or any liability that cannot be lawfully limited or excluded.

8. Limitation of liability

To the fullest extent permitted by applicable law, Porshn shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Site. Our total liability for any claim arising under these Terms shall not exceed EUR 50. This limitation does not apply to liability for intentional misconduct, gross negligence, or any liability that cannot be lawfully limited under Polish or EU law.

9. Changes to these Terms

We may update these Terms. Material changes will be indicated by updating the "Last updated" date. Continued use of the Site after changes constitutes acceptance.

10. Termination

We may suspend or terminate your access to the Site at any time for any reason, including breach of these Terms. You may stop using the Site at any time. To have your waitlist email removed, contact hello@porshn.com.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws rules. Subject to mandatory consumer-protection rules that grant you additional rights under the law of your country of residence, the courts competent for the seat of the controller shall have exclusive jurisdiction over any dispute, unless applicable law provides otherwise.

12. Consumer rights (EU/EEA)

Nothing in these Terms limits your statutory rights as a consumer under Polish or EU law. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
